Infraction Examples – Distractions
Distractions
This is anything that prevents a driver from giving full attention while driving. This is extremely important with medium to heavy duty vehicles. With the weight of the vehicle, it does take longer of the vehicle to come to a stop. Any form of distraction can lead to dangerous incidents.

Cell Phone Handheld Observed.
- The driver is observed holding a cell phone without leading to a risky situation. An example would be if the driver has a cell phone in his lap, but he does not look at it and becomes distracted.

Cell Phone Handheld Distraction.
- The driver is actively using a cell phone device which can lead to potentially risky situations and distraction while driving. The driver could be using a cell phone to talk, text, email, visit a website, social media, etc. while driving.

Cell Phone Handsfree Observed.
- The driver is observed wearing a hands-free device over or in their ears, but no conversation can be confirmed.

Cell Phone Handsfree Distraction.
- The driver is clearly having a conversation using a hands-free device which is a form of distraction.

Electronic Device Observed.
- This is selected if the driver is observed using an electronic device (such as CB Radio, iPad, laptop, tablet, GPS device, etc.) while the vehicle is in motion but did not result in a form of distraction. Example includes looking at a GPS device or using his radio to communicate with dispatch.

Electronic Device Distraction.
- This is selected if the driver is observed using an electronic device (such as CB Radio, iPad, laptop, tablet, GPS device, smartwatch etc.) while the vehicle is in motion and the driver is visibly distracted (not paying attention to the road and what is happening around them).

Food/Drink Observed.
- The driver is observed eating or drinking without losing attention to road conditions. Examples would include:
- Holding an apple in one hand and eating it while driving with the other hand. Or, eating a sandwich while holding it in one hand.
- Drinking a soda from a cup with a straw or NOT having to tip it up high enough to block their view of the road.

Food/Drink Distraction.
- The driver is distracted while eating or drinking ultimately not paying attention to road conditions. Examples would include:
- Using both hands to hold food while driving with knee.
- Drinking from a bottle or cup and having to lean head back to take a drink, taking their eyes off the road.

Passenger Distraction.
- The driver is focused on the passenger resulting in not paying attention to road conditions. Examples would include:
- The passenger shows the driver something that is on his cell phone while the vehicle is in motion.
- The passenger pushing or hitting the driver.
- The driver is focused on the passenger resulting in not paying attention to road conditions. Examples would include:

Smoking.
- The driver is smoking in the vehicle. Smoking refers to cigarettes, vape pens, e cigarettes, etc. This does NOT include the passenger.
